According to a report by Inquirer.net, a four-page legal opinion issued by DOJ Secretary Raul Gonzalez, stated that while there was no specific mention of jai alai in the CEZA charter, the authority was “implied” as CEZA itself was authorized to put up gambling casinos and gaming operations.
This statement has upheld an earlier similar opinion by the Office of the Government Corporate Counsel (OGCC) that stated CEZA had the authority “to establish, manage and operate” jai alai betting stations within the eco-zone.
According to the justice secretary, the CEZA charter stated that among its functions is “to operate on its own, either directly or through subsidiary entity, including games, amusements, recreational and sports facilities such as horse racing, dog racing, gambling casinos, golf course and others.”
Inquirer.net further quoted Gonzalez on the matter:
“While administrative bodies derive their power from the laws of their creation … it has been held that when authority is given by statute to accomplish a stated governmental purpose, there is also given by implication, authority to do everything necessary to accomplish the purpose that is not a violation of the law or of public policy.”
